Terms of Use

These Terms of Use govern your access to and use of Vigil, a mobile monitoring utility operated by Matt Crypto (“Company,” “we,” “us,” or “our”). By downloading, accessing, or using Vigil (the “App”), you agree to these Terms of Use. If you do not agree, do not use the App.

The App is non-custodial in the strongest sense: it contains no wallet, holds no keys, and cannot create, sign, or submit transactions. We may add, remove, change, suspend, or limit features at any time.

We are not responsible for losses caused by misdirected transactions, poisoning attacks the App did not detect, RPC failures, notification delays, or user error.

5. Third-Party Services

The App queries the Solana RPC endpoint you configure. RPC providers are third parties with their own terms and policies, and we are not responsible for their availability, accuracy, or conduct. Wallet applications, exchanges, and other services whose addresses you monitor are likewise third parties unaffiliated with the App; their trademarks belong to their respective owners.

Subject to these Terms of Use, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control. The App’s source code is separately made available under the MIT License at https://github.com/mattcrypto12/Vigil; that license governs the source code, and these Terms of Use govern your use of the distributed App.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL DETECT ANY PARTICULAR ATTACK, THAT ITS DATA WILL BE ACCURATE OR TIMELY, OR THAT IT WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF FUNDS, PROFITS, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF OR RELIANCE ON THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP, IF ANY, AND (B) TEN U.S. DOLLARS (US$10).

You agree to indemnify and hold harmless the Company from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the App or your violation of these Terms of Use.

11. Changes to the App or Terms

We may update the App and these Terms of Use from time to time. Material changes will be reflected by updating the Effective Date above. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms of Use.

12. Termination

You may stop using the App at any time by uninstalling it. We may terminate or suspend availability of the App at any time. Sections that by their nature should survive termination (including Sections 3, 4, 8, 9, and 10) survive.

13. Governing Law

These Terms of Use are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles, except to the extent superseded by applicable law.
